What are my rights?

Guarantee of lawful and secure processing of personal data.

Brepols processes your personal data in a fair and lawful manner. This includes the following guarantees:

  • Personal data will only be processed to the extent that it is adequate, relevant, and not excessive.

  • Personal data will only be stored as long as necessary to fulfill the described and justified purposes in this Privacy Statement.

Necessary technical and security measures have been taken to minimize the risks of unlawful access to or processing of personal data. In the event of a breach in its IT systems, Brepols will immediately take all possible measures to minimize the damage.

Right to access/correction/deletion of your personal data

Upon proof of your identity as a User, you have the right to receive clarification from Brepols regarding whether or not your personal data is being processed. If Brepols processes your data, you also have the right to access the collected personal data. If you wish to exercise your right of access, Brepols will respond within one (1) month from receiving the request. The request can be made via registered mail or by sending an email to info@brepols.com.

Inaccurate or incomplete personal data can always be corrected. It is the responsibility of the User to first correct any inaccuracies or omissions themselves. You can exercise your right to correction by submitting an additional statement to Brepols. Brepols will act on it within one (1) month from receiving the additional statement.

You also have the right to have your personal data deleted without undue delay. You can only invoke this right to be forgotten in the following cases:

  • When the personal data is no longer necessary for the purposes for which it was originally collected;

  • When the personal data was collected based on consent and no other legal basis exists for the processing;

  • When an objection is made against the processing and no overriding legitimate grounds for processing exist;

  • When the personal data has been processed unlawfully;

  • When the personal data needs to be deleted in accordance with a legal obligation.

Brepols will assess whether any of the aforementioned conditions are met.

Right to restrict/oppose the processing of your personal data

The user has the right to obtain a restriction of the processing of their personal data in the following cases:

  • For the period that Brepols needs to verify the accuracy of the personal data, in the case of a dispute;

  • When the data processing is unlawful, and the user requests a restriction of the processing instead of the deletion of the personal data;

  • When Brepols no longer needs the user's personal data for processing purposes, and the user needs the data for the establishment, exercise, or defense of legal claims;

  • For the period that Brepols needs to assess the grounds for the deletion of personal data.

Right to Data Portability

The user has the right to obtain the personal data provided to Brepols in a structured, commonly used, and machine-readable format. Additionally, the user has the right to transfer this personal data to another data controller when the processing of the personal data is solely based on the user's consent.

If the user wishes to exercise this right, Brepols will comply within one (1) month after receiving the request. The request can be made via registered mail or by sending an email to info@brepols.com.

Right to withdraw my consent/right to file a complaint

The user has the right to withdraw their consent at any time. Withdrawing consent does not affect the lawfulness of processing based on consent before its withdrawal. Additionally, the user has the right to file a complaint regarding the processing of their personal data by Brepols with the Belgian Data Protection Authority (Gegevensbeschermingsautoriteit).
